Driver / Carrier Agreement
The terms that apply to drivers and carriers who perform deliveries through MoveIt Delivery.

1. Acceptance
By applying to drive or carry on MoveIt Delivery, claiming or accepting a job through the marketplace, or performing any delivery arranged through the platform, you agree to this Driver / Carrier Agreement and our Privacy Policy. If you do not agree, you may not perform deliveries through MoveIt Delivery.
2. Independent contractor; not a carrier
You are an independent contractor or a third-party transportation provider. You are not an employee, agent, joint venturer, or partner of MoveIt Delivery. You control the manner and means by which you perform deliveries, and you are solely responsible for your own business, taxes, licensing, insurance, and compliance with all applicable transportation, safety, and employment laws.
MoveIt Delivery is a technology and dispatch platform, not a motor carrier, broker, or freight forwarder. The transportation contract for each delivery is between the customer and you. MoveIt Delivery does not take possession of cargo and is not responsible for the physical handling, transport, or custody of goods.
3. Approval and eligibility
You must be approved by MoveIt Delivery before claiming or being assigned jobs. You must be at least 18 years of age, hold a valid driver's licence appropriate for the vehicle class you operate, and maintain a satisfactory safety and performance record. MoveIt Delivery may suspend or revoke approval at any time for safety, legal, performance, or conduct reasons.
4. Licences, insurance, and CVOR
At your own expense, you must maintain all licences, registrations, and insurance required by Ontario and federal law, including but not limited to:
- Valid commercial vehicle registration and, where required, a CVOR certificate.
- Current vehicle safety inspection certificate, where applicable.
- Commercial auto liability insurance covering the vehicle while used for hire.
- Cargo insurance covering goods transported on behalf of customers.
You must provide proof of these documents on request and notify MoveIt Delivery promptly if any licence, registration, or insurance lapses or is cancelled. Driving without required coverage is a material breach of this Agreement.
5. Proof of delivery
For every delivery you must capture geo-tagged before-and-after photographs of the cargo at pickup and delivery, and obtain a signoff from the person on-site at the drop-off location, using the MoveIt Delivery app. The signoff records that the cargo was received; it does not replace a cargo-condition inspection. You may not mark a delivery as delivered without completing these steps. Photographs are stored as delivery records and may be shared with the customer as proof of delivery.
6. Marketplace, claims, and assignments
Approved Drivers and Carriers may view and claim available jobs through the marketplace, or be assigned jobs by dispatch. Claims are processed first-come, first-served at the database level; you may not claim a job already held by another provider, attempt to circumvent the platform, or solicit customers off-platform to avoid fees.
7. Payouts and commissions
Payouts are calculated and frozen at the time you claim a marketplace job. Your payout equals your commission rate multiplied by the job price, plus your commission rate's complement multiplied by the fuel surcharge — equivalently, you receive your commission rate of the non-fuel subtotal plus 100% of the fuel surcharge (the fuel is a full pass-through). The exact commission rate is set during your approval and is adjustable by MoveIt Delivery as the network grows. Jobs you operate as an owner/driver dispatched directly by MoveIt may carry different payout terms recorded on the job. Payouts are paid out according to the method and schedule agreed during onboarding. You are responsible for all taxes on your earnings.
8. Cargo liability
You are responsible for the cargo from pickup to delivery and for any cargo damage, loss, or delay that occurs while the goods are in your custody, subject to the limits and terms of your own cargo insurance. You must handle goods with reasonable care, secure them properly, and follow any special handling instructions. You must notify MoveIt Delivery and the customer promptly of any damage, shortage, or incident.
9. Prohibited conduct
- Transporting illegal goods, undeclared hazardous materials, or items prohibited by law.
- Misrepresenting delivery status, falsifying proof-of-delivery records, or coaching a recipient to sign without receiving goods.
- Charging customers directly, soliciting off-platform, or circumventing MoveIt Delivery's fees.
- Disclosing customer personal information obtained through the platform for any purpose other than completing the delivery.
10. Indemnity
You agree to indemnify and hold harmless MoveIt Delivery and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your performance of deliveries, your operation of a vehicle, your breach of this Agreement, your negligence or wilful misconduct, or your failure to maintain required licences or insurance.
11. Termination and suspension
You are free to stop using the platform and terminate your account at any time, for any reason, by contacting bookings@moveit.delivery. MoveIt Delivery may also suspend or terminate your access immediately for safety, legal, performance, fraud, or conduct reasons, or for failure to maintain required insurance or licensing. Suspension or termination does not relieve you of obligations for deliveries already performed, and amounts already owed (payouts or reimbursements) will be settled as applicable.
12. Dispute resolution
Disputes will first be addressed informally by contacting bookings@moveit.delivery. If not resolved within 60 days, the dispute will be finally resolved by binding arbitration administered in Toronto, Ontario under the applicable rules of the ADR Institute of Canada, by a single arbitrator, except that MoveIt Delivery may bring claims for non-payment or injunctive relief in the courts of Ontario. Each party waives any right to participate in a class action or class arbitration.
13. Governing law
This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
14. Changes
We may update this Agreement from time to time. The effective date above reflects the current version. Your continued use of the platform — including claiming or performing deliveries — after changes are posted automatically constitutes your agreement to the updated Agreement. If you do not agree to the revised terms, you should stop using the platform and may terminate your account as described in Section 11.
